Several non-governmental organisations (NGOs) in Kedah are planning to sue the owner of a nasi kandar restaurant who triggered the Sivagangga COVID-19 cluster that now spans across several states.

Free Malaysia Today (FMT) reported that the Consumers Association of Kedah (CAKE) will lead the civil action, with at least five other NGOs, against the 57-year-old man, as the RM1,000 fine imposed on him was a "slap on the wrist".

"Legal action against him will serve as a warning to others against messing around with COVID-19 quarantine orders.

"We want to take this man to court for he has caused all Kedahans to suffer," CAKE's secretary Mohd Yusrizal Yusoff was quoted telling FMT.

The group is currently speaking with lawyers to get the lawsuit drafted.

The Sivagangga cluster was named after the district in Tamil Nadu, India, where the patient - the nasi kandar shop owner in Napoh, Kubang, is believed to have been infected with the virus during his visit.

The Indian man, with a permanent resident status in Malaysia, flouted the home quarantine order upon his return to Malaysia, and was spotted sitting at his shop wearing a pink band on his left wrist on Hari Raya Haji.

He has since set off a rapidly spreading COVID-19 cluster across several states. Authorities are now investigating if a "super-spreading" coronavirus strain from Egypt is responsible for the cluster.

The rapid spread of the virus in the Kedah even caused the state government to impose Targeted Enhanced Movement Control Order (TEMCO) at four areas surrounding Kubang Pasu.

Yesterday, Kedah Menteri Besar Muhammad Sanusi Md Nor reportedly ordered the closure of the man's nasi kandar restaurant until the end of the TEMCO on Aug 30, and said the state is even considering revoking the restaurant's business licence.

According to reports, almost half of the 132 active COVID-19 cases in Kedah are from the Sivagangga cluster, while the strain has also infected about 125 people in Penang and 30 in Perlis.
